Welcome to Thinking Lens, Inc. (“Company”, “we”, “our”, “us”), a Delaware corporation. These Terms of Service (“Terms”, “Terms of Service”, "ToS") govern your (“Users,” “you,” or “your”) use of our mobile application Thinking Lens (the “App”), as well as any other related products and services operated by us that refer or link to these legal terms (collectively, the "Services").
Thinking Lens is a mobile application that helps users reflect, reframe thoughts, and regain clarity and strength for constructive next steps amidst everyday stress. Over time, it aims to help enhance user’s cognitive flexibility and psychological resilience, contributing to long-term mental strength. It is designed to support users in navigating everyday situation and fostering personal growth. It is complementary to, and not a substitute for, professional mental health care. Thinking Lens is not intended to diagnose, treat, or manage mental health conditions, and should not be used in crisis situations or as a replacement for therapy, counseling, or medical advice. If you are experiencing a mental health crisis or need immediate help, please seek professional assistance from a qualified healthcare provider or contact emergency services.
1. Agreement to Terms
By accessing the Services, you agree that you have read, understood, and agreed to be bound by these Terms of Service, including our Privacy Policy. If you do not agree with (or cannot comply with) these terms, you are expressly prohibited from using the services and you must discontinue use immediately. You may contact us at support@thinkinglens.app so we can try to find a solution.
We may modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.
2. Eligibility
The Services are intended for users over 18 years old. You hereby represent that you have the legal power and authority to agree to this ToS. You are at least 18 years of age, and have neither falsely identified yourself nor provided any false information to gain access to the Application or Services.
3. Access and Acknowledgements
Thinking Lens is free to use with optional subscription-based features rolling out in future versions. We reserve the right to update or modify the app at our discretion, including introducing new features, altering existing features, or removing features as we see fit.
You understand and acknowledge the followings:
- Thinking Lens is not a healthcare provider or a provider of mental health services and does not engage in the practice of medicine. Thinking Lens provides technology applications that support users’ individual efforts at self-care and self-growth. Any decision related to diagnosis, treatment, or both, rests with you and your healthcare provider. You understand that by using the Services, you are not entering into a healthcare provider-patient relationship with Thinking Lens. The Services are not meant to be a substitute or replacement for any in-person healthcare visits, counseling, therapy, psychiatric care or wellbeing visits that may be necessary for the User.
- The App, Services or certain portions thereof are only available within certain jurisdictions and may not be available to you based on your location.
- The App is a work in progress and may have bugs and room for improvement. Please contact us for feedback and suggestions.
4. User Responsibilities
- You agree to use the Services only in a manner that is consistent with its intended purposes that are permitted by this ToS, and in compliance with all applicable laws or regulations, nationally or internationally. You will not use the Services to engage in any unlawful behavior, or to cause damage, harassment, nuisance, annoyance or inconvenience to Thinking Lens, another user of the Services or any third party.
- You agree to access the Services using computer or mobile device equipment that meet the minimum requirements required by the Services (e.g., the mobile device specification and access to the Internet) and as otherwise suggested by Thinking Lens to you.
- You agree to not use any automated programs, data mining tools, web-crawlers or other data gathering or extraction tools in connection with your use of the App, our website, or the Services.
- You agree to not use the App or Services in a way that could cause damage or adversely affect the App or the Services, including means of introducing a virus, use of data sniffing tools, denial of service acts, breaching any security protocols, or spamming the App or the Services.
- You are responsible for maintaining the confidentiality of your account and login information and for all activities that occur under your account.
- You will not sell, resell, rent or otherwise engage in any commercial use of the Services.
- Additionally, you agree not to:

-- Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
-- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Services, the server on which Services is stored, or any server, computer, or database connected to Services.
-- Attack Services via a denial-of-service attack or a distributed denial-of-service attack.
-- Take any action that may damage or falsify Company rating.
-- Otherwise attempt to interfere with the proper working of Services.
5. Registration and Account Creation
You may be required to create an account to access and use the App and the Services. If we require you to create an account, we may ask you to provide certain information, such as your name, age and email address to Thinking Lens, in connection with account creation. If you create an account, you agree to provide information that is current, accurate, and complete, and to maintain and update any information about yourself that you have provided to Thinking Lens. If you do not maintain such information, or Thinking Lens has reasonable grounds to suspect as much, Thinking Lens has the right (but not the obligation) to suspend or terminate your account and your use of the App and/or Services. You agree to keep your account information confidential. You are responsible for all activities that occur under your account and for maintaining the confidentiality of your access information. Thinking Lens may take any and all actions it deems necessary or reasonable to maintain the security of the Services. We may utilize additional security measures from time to time to prevent unauthorized access to your account. You agree to not use anyone else’s account information or permit others to use yours to log into any user account on the App.
6. Privacy
Your use of the app is governed by our Thinking Lens Privacy Policy, which details how we collect, process, and safeguard your personal data. By using the app, you consent to our collection and use of your information in accordance with the Privacy Policy.
7. Subscription & Payment
- Thinking Lens provides free access to users, and you will not be charged any fees unless you opt into additional services or optional subscriptions.
- For access to the optional subscription-based features, we may charge you a fee as displays on the App (the “Subscription Fee”). The subscription is non-transferable and any Subscription Fee paid to us is non-refundable. You may terminate the subscription at anytime before the start of the next subscription term.
- If you are paying the Subscription Fees by credit card, you authorize us to charge your credit card or bank account for such fees. You further authorize us to use a third party to process payments, and consent to the disclosure of your payment information to such third-party payment processors. Your use of the Services will also be subject to the terms, conditions, and privacy policies of such third-party payment processors. Your access to or ability to use the App or Services may be suspended, or you may incur additional charges from the payment processor if your billing contact information is incorrect or not updated in our records. Thinking Lens is not responsible for any damages arising out of any account suspensions resulting from your incorrect billing contact information, or any errors or omissions by the payment processor or by your credit card issuer.
8. No Use by Minors
Services are intended only for access and use by individuals at least eighteen (18) years old. By accessing or using any of Services, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Services.
9. Intellectual Property
- Services and their original content (excluding Content provided by users (”User Content”) ), features and functionality are and will remain the exclusive property of Thinking Lens, Inc. and its licensors. Services are protected by copyright, trademark, and other laws of the United States. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Thinking Lens, Inc..
- Any content that you provide through the App or the Services is your “User Content”. Except for the license you grant below, as between you and Thinking Lens, you retain all rights in and to your User Content.
-- For all User Content, you hereby grant Thinking Lens a license to translate, modify, and reproduce and otherwise act with respect to such User Content, in each case to enable us to operate the Services, for example to generate summaries and insights, and to the extent you have opted-in, for improvement or development of the App or the Services. This is a license only, and your ownership in User Content is not affected.

Provided that when you delete your user account, we will stop displaying your User Content, but you understand and agree that some User Content may not be completely removed. 10. Copyright Policy
- We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Services infringes on the copyright or other intellectual property rights (”Infringement”) of any person or entity.
- If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to support@thinkinglens.app, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”.
- You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Services on your copyright.
11. DMCA Notice and Procedure for Copyright Infringement Claims
You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

12. Error Reporting and Feedback
- You may provide us either directly through in-app feedback and bug report functionality, via email at support@thinkinglens.app, or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Services (”Feedback”).
- You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.
NEITHER COMPANY NOR ANY PERSON ASSOCIATED WITH COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.
